These terms and conditions apply to your Himyan Prepaid Card. You must read them carefully. In these terms and Conditions “you” means the named person Himyan Prepaid Cardholder and the authorized user of the Himyan Prepaid Card. “We’, “us”, or “our” means Qatar Islamic Bank (“QIB’). “Website” means our website at www.qib.com.qa.
By using the Himyan Prepaid Card, the Himyan Prepaid Cardholder agrees to be bound by these terms and conditions.
Himyan Prepaid Card:
You acknowledge and agree that the value available in the Himyan Prepaid Card account is limited to the funds that you have been loaded into the Himyan Prepaid Card account or have been loaded into the Himyan Prepaid Card Account on your behalf.
Your Himyan Prepaid Card is not a credit card and is not in any way connected to your bank account. You will not earn any profit on any funds loaded on your Himyan Prepaid Card.
- Definitions:
QAR means the lawful Currency of Qatar.
ATM means an Automated Teller Machine.
Available Funds means the available credit balance in the Himyan Prepaid Card that is available for utilization or withdrawal, as reduced by any transaction amounts which have been reserved, blocked, are pending or have otherwise not been processed or released.
Prepaid Card means the QIB’s Himyan Prepaid Card issued to the Cardholder by Qatar Islamic bank.
Himyan Prepaid Card Account means the records the Bank maintains to account for the value of claims associated with the Himyan Prepaid Card.
Prepaid Card Application means a duly completed and signed application (in the Bank’s standard format) or the Bank’s supplied PDF format application or any application submitted through any other channel as allowed by the Bank from time to time, and submitted by the Client ( “client”) for obtaining the Prepaid Card.
Issuer means an QIB as a Bank to issue Prepaid Card program (General Purpose) Prepaid Card
Prepaid Cardholder means the person or persons who have received the Prepaid Card and are authorized to use the Prepaid Card as provided for in this Agreement.
Bank means QIB.
Prepaid Card Statement means the statement of the Prepaid Card Account sent by the Bank to the Prepaid Cardholder showing all transaction details affected by the Prepaid Cardholder.
Cash withdrawals means any cash withdrawals obtained by the use of the Prepaid Card, the Prepaid Card number or in any manner authorized by the Prepaid Cardholder from an ATM or POS for debits to the Prepaid Card Account.
Charges means amounts (including any Fees or Charges) payable by the Client arising from the usage of the Prepaid Card under the Terms and Conditions and includes, without limitation, all transactions Fees, Service Charges, additional expenses, damages, legal cost, and disbursements.
Merchant means any person, establishment, company or legal entity which accepts the Prepaid Card.
PIN means the Personal Identification Number issued by the Bank to the Prepaid Cardholder to enable him/her to use the Prepaid Card on the ATM or (POS) Point of Sale.
POS means a Point of Sale where goods or services may be bought by use of the Prepaid Card.
Transaction means the purchase of goods and/or services and/or cash withdrawals made by the use of Prepaid Card and/or the Prepaid Card and PIN.
Preamble: The foregoing (Definitions & Preamble) together with the terms and conditions indicated herein below constitute a “Contract” between the Bank and the Prepaid Cardholder. By accepting and using the Prepaid Card, the Prepaid Cardholder agrees to be bound by these terms and conditions in this Agreement.
Delivery of Prepaid Card:
Normally the Prepaid Card will be delivered through the Bank’s branches, but the Bank reserves the right to deliver it through other media at the request and sole responsibility of the Prepaid Cardholder.
- Prepaid Card Usage:
2.1. The Prepaid Cardholder should sign on the signature panel on the reverse of the Prepaid Card immediately upon receipt of the Prepaid Card.
2.2. Any Transaction supported by electronic log or the imprint of the Prepaid Card are presumed a genuine Transaction unless proven otherwise, irrespective of the signature being present or not on the Transaction slip.
2.3. The Prepaid Cardholder acknowledges and agrees that the value available in the Prepaid Card Account is limited to the funds that the Prepaid Cardholder has loaded into the Prepaid Card Account, or have been loaded into the Prepaid Card Account on his/her behalf.
2.4. The expiration date of the Prepaid Card is identified on the front of the Prepaid Card.
2.5. The Prepaid Card is a Prepaid Card. The Prepaid Card is not connected in any way to any other Account. The Prepaid Card is not a credit Prepaid Card. The Prepaid Card will remain the property of the Bank and must be surrendered upon demand. The Prepaid Card is nontransferable and it may be canceled, repossessed or revoked at any time without prior notice, subject to applicable law. You will not receive any profit on your funds in the Prepaid Card account.
2.6. The Bank’s business days are Sunday through Thursday, excluding Official holidays.
2.7. The Prepaid Cardholder should read this Agreement carefully and keep it for future reference.
2.8. The Bank is not responsible for any act of negligence or denial of service by any Merchant or for damages arising as a result of malfunction of any ATMs, POS terminals or other electronic devices.
2.9. The safety and safekeeping of the Prepaid Card and its related PIN is the sole responsibility of the Prepaid Cardholder. Any Transaction performed on the ATM or where a PIN entry is necessary shall be deemed to be performed by the Prepaid Cardholder himself/herself, if the Prepaid Card is not reported lost, irrespective of the person performing the Transaction.
2.10. The maximum value of the Prepaid Card is restricted to the amount as displayed at the bank’s website / branch under the Pre-Paid Prepaid Card Fees.
2.11. The Prepaid Cardholder may use his/her Prepaid Card to purchase or lease goods or services wherever Naps Prepaid Cards are accepted as long as the Prepaid Cardholder does not exceed the value available on his/her Prepaid Card Account.
2.12. The Prepaid Cardholder is to be aware that some Merchants do not allow Prepaid Cardholders to conduct split Transactions where he/she would use the Prepaid Card as partial payment for goods and services and pay the remainder of the balance with another form of legal tender.
2.13. If the Prepaid Cardholder uses his/her Prepaid Card at a restaurant, a hotel, for a car rental purchase, or for similar purchases, the Merchant may preauthorize the Transaction amount for the purchase amount plus up to 20% or more to ensure there are sufficient funds available to cover any incidental expenses incurred.
2.14. It may take up to seven (7) days or more for the hold to be removed. During the hold period, the Prepaid Cardholder will not have access to the preauthorized amount.
2.15. If the Prepaid Cardholder uses the Prepaid Card number without presenting the Prepaid Card (such as for a mail order, Internet or telephone purchase), the legal effect will be the same as if the Prepaid Cardholder used the Prepaid Card itself.
2.16. The Prepaid Card cannot be redeemed for cash.
2.17. The Prepaid Cardholder undertakes not to use the Prepaid Card for purchase of goods or services that are against the principles of Islamic Sharia (such as gambling, pornography, alcohol or other illegal activities). If the Prepaid Cardholder breaches this term the Bank shall be entitled to cancel the Prepaid Card without prior notice and without any responsibility to the Bank.
2.18. The Prepaid Cardholder is not allowed to exceed the available amount in his/her Prepaid Card Account, through an individual Transaction or a series of Transactions.
2.19. The Bank may monitor an activity on the Prepaid Cards issued to you. Any use of the Prepaid Card, which the Bank considers unlawful (including any criminal activities), fraudulent or suspected to be linked to money laundering may result in suspending your Prepaid Card without further notice by the Bank.
2.20. The Prepaid Cardholder does not have the right to stop payment on any purchase or payment Transaction originated by use of his/her Prepaid Card. The Prepaid Cardholder may not make preauthorized regular payments from his/her Prepaid Card Account. If the Prepaid Cardholder authorizes a Transaction and then fails to make a purchase of that item as planned, the approval may result in a hold for that amount of funds for up to thirty (30) days.
2.21. All Transactions relating to car rentals may result in a hold for that amount of funds for up to sixty (60) days.
- Authorized Users:
The Prepaid Cardholder is responsible for all authorized Transactions initiated and fees incurred by use of his/her Prepaid Card. Any use of the Prepaid Card or access to the Prepaid Card number will be treated by the Bank as being made by the Prepaid Cardholder as if the Prepaid Cardholder has authorized such use and the Prepaid Cardholder will be liable for all Transactions and fees incurred by those persons.
The Prepaid Cardholder is wholly responsible for the use of Prepaid Card(s) according to the terms and conditions of this Agreement.
- Secondary Prepaid Cardholder:
Supplementary Prepaid Cards are not allowed for this Prepaid Card product.
- Loss, theft and Dormant Prepaid Card Accounts:
- If the Prepaid Card is lost or stolen or the Prepaid Cardholder suspects any fraudulent or suspicious activity with regard to the Prepaid Card, the Prepaid Cardholder must immediately report the same to the Bank, its branches. The Bank will make a temporary stop without any responsibility on its part for such an action until the Bank gets a written confirmation of loss or theft from the Prepaid Cardholder.
- The Prepaid Cardholder shall remain liable and accountable for any Transactions prior to the Bank receiving the written confirmation.
- If the Prepaid Cardholder requests a replacement for a lost or stolen Prepaid Card, the Bank may, at its absolute discretion issue a replacement. The issuance fee for such replacement will be debited to the Prepaid Card Account.
- In the event that the lost or stolen Prepaid Card is recovered, the Prepaid Cardholder shall destroy or return it to the Bank without using it in any manner whatsoever, and advise the Bank in writing that it has been recovered.
- Prepaid Cards Accounts that are inactive for a period of one year shall be subject to a transfer to an applicable status as may decide by the Bank. Provided that the Bank shall have made all reasonable efforts to contact the Prepaid Cardholder. If the Bank’s efforts have been successful to contact the Client, the Bank shall handle the Prepaid Card Account in the manner described by Qatar Central Bank.
- Personal Identification Number (PIN):
- The Bank will issue a PIN to the Prepaid Cardholder to authenticate Transactions at ATMs and other PIN based terminals. The Bank will never request the Client to reveal the PIN to a merchant/retailer or to any other party including its employees and any such request should be rejected by the client. The client should report immediately such request to the Bank.
- The PIN will be delivered to the Prepaid Cardholder at the Bank’s branches or sent to the Prepaid Cardholder upon request. However, the charges for carrying out such request will be borne by the Prepaid Cardholder.
- The Prepaid Cardholder shall not disclose the PIN to any other party, and the Prepaid Cardholder shall be fully responsible for any Transaction authenticated by the use of his/her PIN. Accordingly, any PIN related Transaction shall be deemed to be performed by the Prepaid Cardholder.
- Loading your Prepaid Card:
- Funds can be loaded to your Prepaid Card in a number of ways: Visit QIB branches in the initial phase and in future the same will be available via QIB Mobile and Internet banking.
- You must sign the signature strip on the back of the Prepaid Card as soon as it is received. Additional funds may be added to the Prepaid Cardholder Prepaid Card called “value loading.” A Load/ Reload Fee may apply for each Load/Reload that you make. Please, refer to the website for details of when a Load/Reload fee will apply and how much it will be. They will be subject to a reload fee.
- If you are a non QIB customers, you need to visit the following branches to load your card (Tawar Mall and Fanar Branches)
- Authorizing Transactions:
- The entries in the Prepaid Card Statement shall be presumed to be correct unless the Prepaid Cardholder objects to the entries within a period of 30 days from the date of the Prepaid Card Statement and proves them to be incorrect.
- If the Prepaid Cardholder objects to an entry, the Bank will initiate an investigation and advise the Prepaid Cardholder with the outcome. The Prepaid Cardholder shall bear the fee of the investigation in question.
- The Bank is not liable to investigate any Transaction not reported to the Bank by the Prepaid Cardholder within the time frame.
- If the Prepaid Cardholder is entitled to a refund for any reason for goods or services obtained with the Prepaid Card, the Prepaid Cardholder agrees to accept credits to his/her Prepaid Card for such refunds and agrees to the refund policy of that Merchant.
- In case of errors or questions about the Prepaid Cardholder Electronic Transactions, the Prepaid Cardholder must call the Client Service Call Centre, if the Prepaid Cardholder thinks that his/her statement or receipt is wrong or if he/she needs more information about a Transaction listed on the statement or receipt. In this case the Prepaid Cardholder shall provide the Call Centre with all particulars relating to the transaction in question.
- Subject to the features of the particular Prepaid Card, the Authorization of a transaction can include authorizing any single transaction, a series or recurring of transactions (including transactions for an indefinite period) or pre-authorising future transactions of a certain or uncertain amount.
- A Prepaid Card transaction will be regarded as authorised by you where you:
- Authorise the transaction at the point of sale by following the instructions provided by the merchant or retailer to authorise the transaction, which may include:
- Entering you PIN or providing any other security code
- Signing a sales voucher
- Providing the Prepaid Card details and/or providing any other details as requested;
- Waiving or swiping the Prepaid Card over a Prepaid Card reader
- Charges Made in Foreign Currencies:
Himyan Pre-Paid Cards cannot be used outside Qatar as they can be used only locally within Qatar and in QAR currency only.
- Receipts:
- The Prepaid Cardholder shall make sure that he/she gets a receipt at the time he/she makes a Transaction using his/her Prepaid Card.
- The Prepaid Cardholder agrees and undertakes to retain, verify, and reconcile his/her transactions and receipts.
- Prepaid Card Account Balance/Periodic Statements:
- The Prepaid Cardholder is responsible for keeping track of his/her Prepaid Card Account available balance. Merchants generally will not be able to determine his/her available balance. It’s important for the Prepaid Cardholder to know his/her available balance before making any Transaction.
- The Prepaid Cardholder can access his/her available balance by accessing the Prepaid Card Account by calling Client Service Call Centre, anytime, twenty-four (24) hours a day, seven (7) days a week for free.
- The Prepaid Cardholder will be able to enquire about his/her Prepaid Card’s Account movement. But the Prepaid Cardholder will not automatically receive paper statements. A fee will be charged for requesting a statement.
- In case the Prepaid Cardholder requests a statement and does not receive the statement within 30 days he/she should contact the Bank and request a copy of the Prepaid Card Statement. This statement would be provided without additional fee. The Prepaid Cardholder shall have the right to request a statement to be sent to his/her e-mail address free of any charge.
- Upon receiving a statement the Prepaid Cardholder must verify all the Transactions billed on the Prepaid Card statement, and in case of discrepancy, the Prepaid Cardholder shall notify the Bank within 30 days of the statement date.
- If the Prepaid Cardholder does not recognize a Transaction and wishes to receive a copy of the Transaction record, the Bank will arrange to provide such copy in accordance with the NAPS Rules and Regulations and the Prepaid Cardholder will bear the charges relating to providing such copies.
- All notices sent by the Bank to the Prepaid Cardholder’s address last notified in writing to the Bank shall be considered valid and binding.
- The Prepaid Cardholder must promptly notify the Bank in writing of any changes in his/her postal address, contact details or email addres
- Prepaid Card Fee Schedule:
- All fees and charges levied by the Bank under this Agreement shall be borne by the Prepaid Cardholder.
- All fee amounts may be withdrawn from the Prepaid Card Account and will be assessed as long as there is a remaining balance on the Prepaid Card Account.
- In case the balance on the Prepaid Card Account is less than the assessed fee, the entire balance will be applied towards the fee and any outstanding transactions will not be approved due to lack of funds on the Prepaid Card Account.
- For the purpose of this provision, the Bank shall display all fees and charges to be levied by the Bank on the Prepaid Card in a conspicuous place(s) in the Bank’s branches and website.
- Expiration Date:
- The Prepaid Card has an expiration date. The expiration date is simply required to ensure that the Prepaid Card can be used at Merchants that request and/or require the Prepaid Cardholder to provide an expiration date during the Transaction process.
- The Prepaid Cardholder will not be able to use his/her Prepaid Card after the expiration date.
- Confidentiality:
- The Bank may disclose information to third parties about the Prepaid Card or the Transactions made on the Prepaid Card in the situations which shall include but not be limited to:
- Where it is necessary for completing Transactions.
- In order to verify the existence and condition of the Prepaid Card for a third party, such as Merchant.
- In order to comply with government agency, court order, or other legal reporting requirements.
- If the Prepaid Cardholder gives Bank his/her written permission.
- To the Bank’s employees, auditors, affiliates, third party service providers, or attorneys as needed.
- The Bank’s Liability:
- The Bank shall not be liable to the Prepaid Cardholder unless the liability in question results from gross negligence or willful misconduct from the Bank’s acts or omissions. The Bank shall not be liable, for any damages or loss which result to the Prepaid Cardholder from the following instances:
- If through no fault of the Bank’s, the Prepaid Cardholder does not have enough funds available on his/her Prepaid Card to complete the Transaction.
- If there is a hold or the funds are subject to legal process or other encumbrance restricting their use.
- If a Merchant refuses to accept the Prepaid Card.
- If an electronic terminal where the Prepaid Cardholder is making a transaction does not operate properly and the Prepaid Cardholder knew about the problem when they initiated the Transaction.
- If access to the Prepaid Card has been blocked after the Prepaid Cardholder has reported the Prepaid Card has either been lost or stolen.
- If Bank has reason to believe the requested Transaction is unauthorized;
- For delays or mistakes or errors or omissions resulting from any circumstances beyond the Bank’s control, including, without limitation:
- Acts of governmental authorities, national emergencies, insurrection, war or riots;
- The failure of merchants/retailers to accept or honor the Prepaid Card;
- The failure of merchants/retailers to perform or provide services;
- Communications system failures; or
- Mechanical defects, failures or malfunctions attributable to the client equipment, any internet service, or any payment system.
- Any other exception stated in this Agreement.
At all circumstances, if ever liability is laid at the Bank door and/or the Bank is held liable under the terms and conditions or law, the client agrees that s/he will not be entitled to recover other than actual damages for any liability on the part of the Bank. For clarity, in no event shall the client be entitled to recover any indirect damages, cost (including legal cost) , consequential , exemplary or special damages (whether in contract, tort or otherwise), even if the client has advised the Bank of the possibility of such damages.
- To the extent permitted by law, the client agrees that all client against the bank shall be
- LIMITED LIABILITY to the available balance on the Prepaid Card at the time just prior to of the occurrence of any proven liability (subject of the particular claim in question).
- The Prepaid Cardholder’s Liability for Unauthorized Transactions:
If the Prepaid Cardholder fails to notify the Bank about the stolen or lost Prepaid Card in the manner and time indicated in this Agreement, the Prepaid Cardholder shall be liable for any unauthorized transaction on Prepaid Card Account. The Prepaid Cardholder acknowledges and undertakes that any loss sustained by him/her shall be at the cost and expense of the Prepaid Cardholder.
- Amendment and Prepaid Card Cancellation:
- We may change these terms at any time. The up-to-date version of the Prepaid Card terms and conditions will always be available on the website. The changes will automatically take effect and you will be taken to have accepted the notified change unless you tell us that you do not agree to the change, in that event, we will treat that notice as notification that you wish immediately to terminate. In such circumstances we will refund any balance on the Prepaid Card in accordance with QIB’s refund and cancellation terms.
- The Bank has the right to cancel, withdraw or suspend fully or partly or restrict use of the Prepaid Card at any time without any notice and/or advice to the Prepaid Cardholder.
- The Prepaid Cardholder may request the cancellation of the Prepaid Card anytime in writing. The Prepaid Cardholder will be released of all liability pertaining to the Prepaid Card Account, after:
- Surrendering the Prepaid Card
- A period of 45 days from the cancellation of all Prepaid Cards and confirmation that there is no Transactions or dues outstanding
- The Prepaid Cardholder’s termination of this Agreement will not affect any of the Bank’s rights or obligations arising under this Agreement prior to the said termination.
- General: Assignment, Law & Jurisdiction, and Language:
- The Prepaid Cardholder’s Prepaid Card and his/her obligations under this Agreement may not be assigned. The Bank may transfer its rights under this Agreement. Use of the Prepaid Card is subject to all applicable rules and customs of any clearinghouse or other association involved in Transactions. The Bank does not waive its rights by delaying or failing to exercise them at any time. If any provision of this Agreement shall be determined to be invalid or unenforceable under any rule, law, or regulation of
- any governmental agency, the validity or enforceability of any other provision of this Agreement shall not be affected.
- These terms and conditions shall be governed by the laws of Qatar to the extent they do not conflict with the principles and rules of the Islamic Sharia, as determined by the Sharia’s Supervisory Board of the Bank. In case of any conflict between the said laws and regulations, the ruling of the principles of Islamic Sharia shall prevail. The parties hereby submit to the exclusive jurisdiction of Qatari courts for any proceedings or dispute arising out of or in connection with this Agreement.
- This Agreement is issued in Arabic and English versions and in case of any contradiction between the two versions the Arabic version shall prevail.
- Warranties, Liabilities and Disclaimers:
- The Prepaid Cardholder understands, undertakes and accepts that it is strictly forbidden to make use of the Prepaid Card service in order to pay for illegal material as well as illegal downloads or any other goods and services infringing intellectual property rights of a third party and/or any illegal purpose or criminal activity of any nature including activities to launder money to finance terrorism as defined by governing law of this Agreement.
- The Bank’s NAPS Prepaid Card reserves the right to apply at its sole discretion prevention and detection procedures and suspend accounts or refuse the execution of Transactions if there are reasonable grounds to suspect that an Account of a Prepaid Cardholder is being or may be used for illegal purposes.
- The Prepaid Cardholder agrees that the Bank shall in no way, and under no circumstances, be liable for any damages or losses, including without limitation, direct, indirect, consequential, special, incidental or punitive damages deemed or alleged to have resulted from or caused by any act relating to or arising from Agreement unless the same is a direct result of the Bank’s gross negligence or willful mission.
- The Prepaid Cardholder agrees to release, indemnify, and hold the Bank harmless against any claim
- Brought against the Bank by a third party resulting from the Prepaid Cardholder’s use of the Bank Himyan Prepaid Card.
